43.The Madurai Bench of the Madras High Court, in 2017- SCC Online Madras-25932, in the case of K.R.Raja vs. The State of Tamil Nadu and another, had issued directions to follow the direction laid in Ramamurthy Vs. State of Karnataka reported in (1997) 2 Supreme Court Cases 642, wherein, Open Air Prisons were directed to be constructed in every district. The Madurai Bench of the Madras High Court had also directed the Government to construct Open Air Prison in https://www.mhc.tn.gov.in/judis 35 every district in Tamil Nadu.

9. The Apex Court in Ramamurthy v. State of Karnataka indicated thus (Para 9) The argument that when Ramamurthy had gone out, he had better opportunity of doing away with deceased rather than at the house of PW. 2 does not carry the matter far because the manner in which or the place where the crime should be committed would depend upon the attitude of the accused. He might have thought that doing away with the deceased inside the house will have less chance of discovering of his acts rather than in an open area. In the circumstances, we find that none of the arguments suggested against the conclusions reached by the High Court can be sustained.
