Speaking for the Bench M. Jagannadha Rao, J., as His Lordship was then in Kesavanarayana's case (supra) held that the above observations of the Supreme Court would not apply to cases where the right to obtain a personal decree against the father was barred by limitation or any law for the time being in force. In other words, the judgment of A.P. High Court is that the sons' shares are not liable to discharge the
mortgage debt of the father unless there is a personal decree against father. The mortgagee cannot proceed against the son's share in joint family property without obtaining a personal decree against the father when it is barred by limitation.
