In support
of his contention, learned counsel for the applicant has cited the
judgment of Hon'ble High Court of Madhya Pradesh dated
04.02.2021 passed in W.P. No. 1672/2018 - Sudhir Sharma Vs.
State of M.P which has been affirmed by the Division Bench of Hon'ble
High Court on 08.07.2021 in Writ Appeal No. 273/2021 and submitted
that since the applicant being a labourer is capable to earn his livelihood,
therefore, the impugned order dated 08.09.2023 may be set aside and
direction may be given to the respondents to release family pension in
favour of the applicant.
