13. The decision of Supreme Court in C.E.S.C Ltd. and Ors. v. Subhash Chandra Bose and Ors. (supra) is squarely applicable in the present case, because in the present case also no supervision is being carried out by in a appellant company as it is clear from the evidence of Jagdish Prasad. Sharma which is unconnected on this point and Corporation has not given any evidence in rebuttal and therefore I am of the view that in the peculiar facts and circumstances of the present case, the employees of the contractors would not come under the ambit and sweep of 'employee' as envisaged under Section 2(9) of the Act and the appellant company is not required to give its ESI contribution for them.

RIGHT TO HEALTH The right to health, and access to healthcare are also crucial facets of the right to life guaranteed under Article 21 of the Constitution.46 LGBT persons being a sexual minority have been subjected to societal prejudice, discrimination and 46 Common Cause (A Registered Society) v. Since Section 377 criminalises “carnal intercourse against the order of nature” it compels LGBT persons to lead closeted lives. As a consequence, LGBT persons are seriously disadvantaged and prejudiced when it comes to access to health-care facilities. This results in serious health issues, including depression and suicidal tendencies amongst members of this community.47 LGBT persons, and more specifically the MSM, and transgender persons are at a higher risk of contracting HIV as they lack safe spaces to engage in safe-sex practices. They are inhibited from seeking medical help for testing, treatment and supportive care on account of the threat of being ‘exposed’ and the resultant prosecution.48 Higher rates of prevalence of HIV-AIDS in MSM, who are in turn married to other people of the opposite sex, coupled with the difficulty in detection and 47 M.V. Mr. Gupta appearing for the Provident Fund Authority submitted that there was no manner of dispute that the writ petitioner got the work done through contractors. Under the scheme of the said act they were liable to pay the Provident Fund dues of the employees of the contractor. He also added that whether the contractor was doing work exclusively for the writ petitioner or was also working for others did not matter because the Act did not make any kind of differentiation between these two types of contractors. He relied on the principles laid down in the case of M/s P.M. Patel & Sons and others v. Union of India and Others reported in AIR 1987 SC 447 and C.E.S.C. Ltd. v. Subhas Chandra Bose and others reported in AIR 1992 SC 573.

35. We would also say that construction of a hostel like the one at hand has some relationship even with social justice. The hostel being meant for accommodation of working women, who have to be regarded to belong to the weaker section of the society, Article 46 of the Constitution comes into play which requires protection of weaker section of the people from social injuistice and all forms of exploitations. It would be apposite to mention here that the right to social justice has even been regarded as a part of fundamental right. This is what has been stated by K. Ramaswamy, J. in para 30 of C.E.S.C. Ltd. v. Subhas Chandra Bose, (1992) 1 SCC 441 : (AIR 1992 SC 573). Though Shri Mohapatra has described this as soaring of the learned Judge "on the Wings of the eagle", may we say that high ideals and higher imaginative ideas are necessary to pull high a concept which lies in dorment.
