State vs 1) Shiv Shankar on 19 December, 2011
33. Though it is being submitted by Ld. Amicus Curiae while relying on
judgment of Hon'ble High Court titled as Radha Raman Vs State 2010 [3] JCC 1764
wherein it has been held that it is equally difficult for the accused to prove motive for
witnesses to falsely depose against him, I am of the opinion that the fact of the said case
cited by Ld. Amicus Curiae are entirely different from facts of the present case. The
overall facts and circumstances of this case clearly show that Prosecutrix who had come
to Delhi barely two months prior to incident in question and was in search of a job after
being harassed by erstwhile employer was induced by the accused persons on the
pretext of securing a good job for her.
