9.2. Mr. Sengupta relied upon the decision in Eveready Industries (India) Ltd. and Ors. v. Regional Provident Fund Commissioner, 2003(2) LLJ 1034. Having gone through the said decision we do not think that the ratio decided therein can help us in the present context, inasmuch as ultimately it was found in the said decision that until the question of guilt is affirmed the question of payment does not arise. However we do not express any view with regard thereto except as we have held in this decision.
