20. Mr. J.R. Mittal, learned senior counsel for the respondent-decree holder also relied upon the judgment of this Court in Jai Dev v. Prem Singh Sainh 2001 (2) R.C.R. (Civil) 561 (P & H) to contend that if in the decree there is no stipulation that if the decree holder does not deposit the remaining sale consideratio; within a period of 3 months the suit of the plaintiff stands dismissed. In that situation, it is open to the court to extend the time for deposit of sale consideration.
