56. It is submitted that PW6 S.K. Pant shadow witness is a
tutored witness and his evidence should be discarded in toto. He
is referring to his statement dated 21.12.2011 (page 7) where he
has admitted that he has gone through his statement to refresh his
memory before coming to the witness box. He has been relying
upon Rishipal vs. State 1994 (1) CCC 509 Delhi where it was held
that evidence of tutored witness should be discarded and who is a
tutored witness - a person who has been read over his statement
before coming to the witness box.
