The apprehension that was expressed by the learned counsel for the respondent nos.1 and 2 to the effect that their right of appeal will be lost if the suit is transferred to the High Court does not merit consideration. The issue is no longer res integra and has been decided by the division Bench of this Court in the case of Swami Vasudevanand Saraswati Disciple of Swami Shanta Nand Saraswati Vs.
