5. Mr. Nanavaty has invited our attention to a couple of decisions. The first decision is in Valley Noor Mohamad and Anr. v. State of Gujarat 14 GLR 10. In that decision, it has been observed by this Court that while judging whether a particular provision is regulatory in character, what is necessary to be considered is the effect and substance of such a provision and not its form.
