25. For these reasons, I am inclined to hold that
the First Appellate Court has fallen in error in dismissing
the Appeal purely on a technical ground and mis-directed
itself in overlooking the relevant provisions contained in
the CPC as alluded above and the principles of law laid
down by the Hon'ble Supreme Court.
