Besides, Section 540 which is a general section also confers the same powers on him. It lays down that any Court, may, at any stage of any inquiry, trial or other proceedings under the Cr. P.C. summon any person as a witness, or examine any person in attendance, though not summoned as a witness, or recall and re-examine any person already examined and that the Court .shall summon and examine or recall and re-examine any such person, if his evidence : appears to it to be essential to the just decision of the case. This is a general section, which applies to all proceedings under the Criminal Procedure Code. The same view was taken by the Assam High Court in Ghutu Akanda v.
