61. The above legal position is well settled. The decision of the Supreme Court in the case of Re: P.C. Sen followed FAO 168/2020 Page 39 of 49 by learned Single Judges of the Allahabad High Court is eloquent enough in this context. The Allahabad High Court in Lakhan Singh v. Balbir Singh - AIR 1953 Allahabad 342 (D.B.) has observed thus:-

86. On behalf of the petitioner it was urged that a clear and present danger test should be applied to cases like the present as has been the practice of the American Courts. In the view that I have expressed above it is not necessary for me to enter into any detailed discussion of this question. I have expressed my view on the point in delivering the judgment of a Bench of this Court in connection with a contempt case (see -- 'Lakhan Singh v. Balbir Singh', AIR 1953 All 342 (Z4) ).

C. K. Daphtary & Ors vs O. P. Gupta & Ors on 19 March, 1971

In Lakhan Singh v. Balbir Singh (3) it was held that "the law of contempt as laid down by British and Indian Courts imposes resonable restrictions on the exercise of the right of freedom of speech and expression and the previous law continues in force even after the amended Art. 19(2) of the Constitution." It was further stated that "conditions in India, are different from those prevailing in America. The language of our Constitution after the amendment of Article 19 requires us to see whether the restrictions are "reasonable"." It is true that this case was dealing with a publication which prejudiced mankind against a party before the case was heard, but the general observations are relevant for the purpose of this case.
