45.In case titled State of Rajasthan Vs. Naresh @ Ram Naresh
2009 (9) SCC 368 SC while dealing with a murder case based on
circumstantial evidence, it was held that ,
"........These facts raise suspicion but do not prove the
commission of murder............. unless and until
evidence reduced clearly and pointedly establishes the
guilt of accused, order of conviction can not be
passed."
