In the case of Rameshbhai Chandubhai Rathod (supra), the Court while dealing with a case of rape and murder of a child by the watchman, commuted the death sentence to that of imprisonment for life, directing it to be of full life on the ground that it did not fall in the category of rarest of rare cases, because the accused was young person of 27 years and there was possibility of his rehabilitation.
