31. The Apex Court as far back as in 1954 in case
of Cooverjee B. Bharucha vs. Excise Commissioner and the
Chief Commissioner Ajmer and others, reported in AIR 1954
SC 220 as well as in case of Saghir Ahmad and another vs.
State of U.P. and others, reported in AIR 1954 SC 728 held
that it cannot be denied that the State has power to prohibit trades
which are illegal or immoral or injurious to the health and welfare
of the public and such traders cannot legally claim the privileges
under Article 19(1)(g) of the Constitution of India.
