Even otherwise, CW 1 who is an attorney holder of the complainant fulfills the
condition laid down by the Hon'ble Supreme Court in Janki Vashdeo Bhojwani (Supra) as CW
1 has been a part of the entire transaction in question and has been personally aware of all
the facts leading to the filing of the present complaint case. Therefore, the reliance placed by
accused on the said judgment to argue that CW 1 was not the competent witness and could
not have deposed substituting complainant as a witness, is factually misconceived and
cannot be agreed upon.
