16. He submits that order dated 03.07.2023 was obtained on false
statement made by the petitioner with respect to ownership and possession
of property being with respondent no. 3, which is not the case. He submits
that the interest of a bonafide purchaser in an auction sale is ought to be
protected. To buttress his contention he has placed reliance on the decision
of the Supreme Court in Ashwin S. Mehta and Anr. Vs. Custodian and Ors.
