Insofar as the petitioner's contention that the replacement of the cards
is in violation of the orders passed by the Supreme Court in Confederation
of Ex-Servicemen Associations and Others vs Union of India and Others
(supra) is misplaced. In that case, the Supreme Court had considered the
challenge of the petitioner to the ECHS Scheme. The petitioners therein had
claimed that ex-servicemen were entitled to free medical aid and the
requirement to make a contribution to the ECHS Scheme was violative of
Articles 14 and 21 of the Constitution of India. The Supreme Court had
repelled the said challenge and inter alia observed as under:
