8. The scope of Section 155 of the Companies Act, 1956, is now beyond controversy. It is the settled view of most of the High Courts that the summary remedy provided by Section 155 need not be availed or the Courts may decline to exercise the power under Section 155 leaving it open to the aggrieved party to seek remedy before a regular court, where there exists a serious dispute relating to the title of a party to the proceeding.
