19. The “Armchair rule” is one of the main rule the Courts will use while
interpreting whether a Will is a genuine Will or not. Under the Armchair rule,
the Court tries to put itself in the “armchair” of the testator so it can see the Will
and understand its wording through the testator's eyes. The judgments relied
upon by the learned counsel for the appellants referred to supra as well as the
recent judgment of the Hon'ble Supreme Court in the case of Kavita Kanwar
Vs. Pamela Mehta reported in 2021 (11) SCC 209 lays down the following
principles which govern the adjudicatory process concerning the proof of Wills:
