In the case of Md. Isak Md. Vs. State of Maharastra
AIR 1979 (SC) 1434, deceased was assaulted after sudden
exchange of abuses. The Apex Court held that there was no
evidence to gather intention to cause death and it was
observed that intention was to cause grievous hurt and the
offence fell u/s 325/34 IPC and not u/s 304 (1) IPC and
conviction was altered accordingly. Following observations
