In the light of
the law laid down by the Hon'ble Apex Court in Sarup Singh Gupta case
cited supra, I hold that in the case on hand, there is no animus to treat the
appellants as tenants and hence, mere acceptance of portion of the arrears of
rent would not amount to waiver of notice under Section 106 of the Transfer
of Property Act. Therefore, Substantial Question of Law Nos.1 to 3 are
answered against the appellants and in favour of the respondent.
