13. Advocate Mr. Asokan relying on the decision of the Apex Court in Rosy v. State of Kerala argued that as revision petitioners did not challenge the procedure adopted by the learned Magistrate at the time of recording the evidence of PW6 and did not challenge the procedure even at the time of hearing W.P.(C) 3959/05 by this Court and having availed the opportunity of cross-examining the witness, irregularity if any has not caused any prejudice and as provided under Section 465 of the Code the irregularity did not cause any failure of justice, no interference is warranted.
