This Special Appeal has been filed by the State-appellant against the Judgement and order dated 10.05.2019 passed by learned Writ Court in Service Single No. 7212 of 2019 (Naveen Kapoor Vs. State of U.P. and others) whereby the recommendation of the D.P.C. dated 08.03.2019 by which promotion of the private respondents in the writ petition for the post of Chief Engineer (Level-II) (Mechanical) as well as the consequential promotion orders dated 09.03.2019 have been quashed and further directed the respondents to make fresh selection on the post of Chief Engineer (Level-II) (Mechanical) in the Department of Irrigation and Water Resources, strictly on the basis of merit and in accordance with Rules 1990 and Rules, 1994 as well as Government Order dated 20.11.2017, preferably within a period of six weeks from the date of presentation of a certified copy of the order.
