After taking into consideration the submissions made by the respective parties to the present case and in particular, the judgment of the Hon'ble Supreme Court in the case of Rathi Menon (supra), this Court is left with no alternative other than to hold that the present appeal by the Central Railways lacks merit and the contentions raised on behalf of the appellant are no longer res integra and have been settled by the Hon'ble Supreme Court.
