10.    It is made out from the above provision as well as from the view taken by the Hon'ble Supreme Court in Rita Devi & Ors. vs. New India Assurance Co. Ltd. & Anr. (supra) that every murder cannot be stated to be an 'accident'.  A planned and intentional murder would come under the category of 'murder simplicitor' and it could not be an 'accidental murder'.

7.      The main issue that merits consideration in the matter is whether every murder comes under the category of 'accident' or not.  The matter has already been examined in detail in an order passed by this Commission on 27.03.2017 in Revision Petition No. 3995/2012, LIC of India vs. Penti Aruna & Ors.  In the said order, the orders passed by the Hon'ble Supreme Court in Rita Devi & Ors. Vs. New India Assurance Co. Ltd. (supra) as well as the order passed by this Commission in Maya Devi vs. Life Insurance Corporation of India (supra) have been discussed in detail.  The provisions contained in the Halsbury's Laws of England, volume-25, Page 311, Para 575, 4th Edition (2003 reissue), have also been discussed in the said order.  It shall be worthwhile to quote from the orders mentioned above.
