SCC 253 has held that the procedure of preliminary inquiry envisaged
under Section 340 CrPC, is not meant to decide the guilt or innocence of
the party against whom proceedings are to be taken before the Magistrate.
The scope of such proceeding is confined to see whether based on the
material available, it is expedient in the interest of justice that an inquiry
be made.
