Rajendran vs. CBCID, (2013) 12 SCC 481, wherein the Apex Court has observed that rare and exceptional cases can be transferred from State Police to CBI, where it is necessary to do justice and instill confidence in the investigations and to ensure that the investigations are conducted in fair and honest manner; where the State Police lacks credibility and where high state officials and authorities are involved and are likely to influence investigation; where investigations are tainted/biased and where they have national or international ramifications. It is claimed to be a gigantic scam, which is likely to influence the investigation/victims.

Sakiri Vasu vs State Of U.P. And Others on 7 December, 2007

24. Status Report has been filed on behalf of CBI, wherein it is submitted that in the case of Sakiri Vasu vs. State of UP, AIR 2008 SC 907, the Apex Court had observed that this Court or the High Court has power under Article 136 or Article 226 of the Constitution of India to Order investigation by CBI. However, this should be done only in some rare and exceptional cases, otherwise, the CBI would be flooded with a large number of cases and would find it impossible to do proper investigations.
