41. As per the provisions of the Land Revenue Act, land
comprising water bodies cannot be alienated for any
purpose and the cultivation carried on the tank beds or
water bodies does not denude the land of its character as
water bodies. It is settled that when there is a serious
dispute with regard to the existence of water body, it
cannot be decided in a writ petition exercising jurisdiction
under Article 226 of the Constitution of India (See
Sarvepalli Ramaiah v. District Collector, Chittoor
District9).
