In view of the law laid down by the Division
Bench of this Court in Mahadevaiah's case referred to
supra and followed by this Court in W.P.No.833/2007
(L-MW) disposed off on 17.09.2008 under the
Minimum Wages Act and also subsequently followed in
W.P.No.41852/2011 (L-PG) disposed off on 18.04.2012
the principles laid down therein would squarely apply
to the facts and circumstances of the case the order
impugned in the present writ petition cannot be
sustained in the absence of the State having not been
made party to the proceedings.
