Insofar the judgment of the Supreme Court in the case of Associate Builders
vs. Delhi Development Authority (supra) relied upon by learned senior counsel for
the respondent is concerned, in my view even the said judgment does not assist the
respondent since the leaned arbitrator has rendered perverse findings and the award
rendered by the learned arbitrator is contrary to and de-hors the terms of the
contract. The learned arbitrator has allowed the time barred claims. The procedure
followed by the learned arbitrator in this matter is unknown to law and is in
violation of the principles of natural justice. The award shows patent illegality and
shocks judicial conscience of the Court.
