Accordingly, I do not find any judgment relied upon by learned
counsel for the petitioner to be applicable to the facts and circumstances of
this case. However, the judgments relied upon by learned counsel for the
respondents are squarely covering the issue involved, as in all the cases,
namely, Jayakrishna Manharaj Mohapatra's (supra), Nand Ram's case
(supra), Maya Devi's case (supra), Kehar Singh's case (supra),
Samarendra Nath Sinha's case (supra) and Bhagwan Dass's case
(supra), the consistent stand of this Court is that the statutory interest
provided under Section 28 of the Act is an integral part of the decree to be
passed by the Court while determining compensation under the Act and has
to be awarded, which can always be corrected on an application filed under
Section 152 of the CPC.
