It is clear therefore that under the above provisions suits and execution applications alone are to be decided according to the provisions of the new Act. I can safely presume that the. authority in Alley Rasul Ali Khan v. Balkishun ('34) 21 A.I.R. 1934 All. 709 was before the Legislature when Section 296 was enacted. Specific reference was made to suits and to execution applications, but no provision was made regarding appeals, and it is reasonable to infer that appeals were left to be decided in the manner in which the earlier authorities left appeals to be decided.

a right of appeal in a suit is governed by the law prevailing at the date of the institution of the suit, and not by the law prevailing at the date of the decision of the suit or at the date of the filing of the appeal.
