view of the above, the repairing work which the petitioners want to
carry out is tenantable repairs, and therefore, in view of the law
laid down by our High Court under the provisions of the Rent Act
applicable to the present case, judgment of Madras High Court
Doraipandi Konar (supra) relied on by the learned advocate for the
respondent which is in the context of the Madras Buildings (Lease
and Rent Control) Act cannot have any application for deciding the
controversy involved in the present petition. Equally, the judgment
of Calcutta High Court has also no application.
