74. Learned Counsel Sri Y.K.Narayana Sharma sought to
rely upon the judgment of the Apex Court rendered in the
case of KALE & OTHERS Vs. DEPUTY DIRECTOR OF
CONSOLIDATION AND OTHERS - AIR 1976 SC 807 to
contend that the Palupatti is required to be accepted since it
was entered into voluntarily without there being an element
of fraud, coercion or undue influence. This judgment can be
of no relevance in this case since the execution of Palupatti is
stoutly denied and as noticed above, the execution of
Palupatti itself has not been established.
