However, considering the age and occupation of the deceased and the year of the accident i.e., 2017 and also in view of the guidelines provided for settlement of the cases before the Lok-Adalath, it is just and necessary to consider the income of the deceased at Rs.10,250/- per month for the purpose of awarding compensation. The compensation awarded by the Tribunal under the conventional heads, loss of love and affection needs to be reassessed in view of the Judgment of Hon'ble Supreme Court in the case of National Insurance Ltd. Vs. Pranay Sethi and Others reported in AIR 2017 SCC 5157. Thus, on reassessment, the following just compensation is awarded. Income of deceased is considered at Rs.10,250/- per month, 1/4th is deducted towards the personal and living expenses of the deceased which has comes to Rs.7,687/- per month which to be multiplied
