This obviously would lead to a situation where the Official Receiver's rights would depend on the religion of the insolvent and whether the insolvent is a Hindu or a Non-Hindu. Obviously there cannot be any such discrimination in the eye of law. Had the mutter been res integra I would not have hesitated to point out that Section 28-A of the Provincial Insolvency Act, does not in any way improve the position of the Official Receiver just because the insolvent happens to be a Hindu.
