23. The appellate court is empowered to reappraise the
entire evidence against the order of acquittal and come to its
conclusion, but while doing so, it must not only consider every
matter on record having a bearing on the questions of facts but

must also consider the reasons given by the trial court in support of
its orders of acquittal in arriving at its conclusion on those facts,
but should also express its own reasons in its judgment on those
issues which led it to hold that the acquittal was not justified. This
principle has been laid down by the Hon'ble Supreme Court in
Sanwat Singh vs. State of Rajasthan, reported in AIR 1961 SC
715 which reads as under:-
