19. The decision relied upon by the learned counsel for
respondent No.1, reported in (2011) 7 SCC 493 in the
case of ITC LIMITED v/s STATE OF UTTAR
PRADESH AND OTHERS would aptly apply to the facts
of the present case. In the said decision, the Hon'ble
Apex Court among other questions was considering the
question, when allotment has been followed by grant of
lease (which is duly executed) and delivery of
possession in favour of the lessee, whether lease could

be unilaterally cancelled by the Lessor. At paragraph 30
of the judgment, the Hon'ble Apex Court made
distinction between the lease governed exclusively by
the provisions of Transfer of Property Act, 1882 and
grant of lease governed by the statute or statutory
regulations. The Hon'ble Apex Court at paragraphs 30,
31, 32 and 33 observed as follows:
