Taking note of various instances where there was
large scale destruction of public and private property in the
name of agitation, bandhs, and the like, Hon'ble the Supreme
Court initiated suo motu proceedings. Two committees were
appointed. One headed by Retired Judge of Hon'ble the
Supreme Court and one headed by Mr. F. S. Nariman, a senior
member of the Bar. The report given by Justice K. T. Thomas,
which form part of judgment of Hon'ble the Supreme Court
reported as Destruction of Public & Private Properties In Re.
vs State of AP. and others 2009 (5) SCC 212, and the
recommendations of Hon'ble the Supreme Court thereon are
extracted below:-
Bhagirathsinh S/O Mahipat Singh Judeja vs State Of Gujarat on 21 November, 1983
"17. It was contended by the learned counsel for the
appellants before us, and it was also contended
before the High Court, that the considerations for
cancellation of bail are different from the
consideration of grant of bail vide Bhagirathsinh
vs State of Gujarat (1984) 1 SCC 284, Dolat Ram
vs State of Haryana (1995) 1 SCC 349 and
Ramcharan vs. State of M.P. (2004) 13 SCC 617.
However, we are of the opinion that that is not an
absolute rule, and it will depend on the facts and
circumstances of the case.
