3 of the Immoral Traffic (Prevention) Act, 1956 is in respect of
punishment for keeping a brothel or allowing the premises to be
used as brothel and, therefore, provisions of Section 3 of the Act
also would not be applicable in the facts of the case and, therefore,
the decision of this Court in the case of Vinod @ Vijay Bhagubhai
Patel v. State of Gujarat and another (Supra) would be squarely
applicable in the facts and circumstances of the case.
