30. Further-more, the Education Department, Government of Bihar, vide its letter No. 1122, dated 16.06.2015, (Annexure-D to the counter affidavit), informed the BPSC that the Supreme Court, in P. Suseela (supra), has put to rest the controversy, with respect to exemption of candidates from passing the NET test, who have been awarded Ph.D./M.Phil degree prior to the University Grants Commission (Minimum Standard and Procedure for Award of Ph.D. Degree Regulation) 2009. It is further submitted that from a reading of the said judgment, it is apparent that for appointment on the post of Assistant Professor, in Universities/Colleges, passing of NET is essential requirement and those candidates would be exempted from passing the NET test, who have been awarded Ph.D. Degree, in compliance of the University Grants Commission (Minimum Standard and 20 Patna High Court LPA No.227 of 2016 /28 Procedure for Award of Ph.D. Degree Regulation), 2009, and the candidates‟ passing of NET was an essential qualification.

The respondents accordingly contended that the appellants have neither qualified NET/SLET/SET nor they are Ph.D. holders, on the basis of Minimum Standard And Procedure Regulation, 2009, framed by the UGC, for M.Phil/Ph.D Degree, and, therefore, their lack of qualification was the sole basis for rejection of their candidature by the Bihar Public Service Commission, stating to the effect that the appellants had neither 27 Patna High Court LPA No.227 of 2016 /28 NET nor Ph.D qualification. Learned counsel for the respondents have also referred to a decision of this Court, in Rakesh Kumar Singh & Ors Vs. Union of India & Ors and its analogous cases, reported in 2015 (4) PLJR page 477, to sustain their arguments. However, both the judgments, referred to above, relate to the minimum standard and procedure for award of Ph.D. Regulation, 2009, and the issue at hand, relating to exemption from NET/SET, has not been considered therein.
