In this
case, taking note of the fact that the Respondent-Wife is unable to maintain
herself and she is in a penurious condition, the learned Judge relied on the
decision of this Court in Mani Vs. Jayakumar reported in Crl L J 3708 to
conclude that when it is proved that the Respondent has no independent source
of income of her own, the Petitioner is under an obligation to pay maintenance
to her. Such a conclusion arrived at by the Court below cannot be said to be
arbitrary and illegal. There is no acceptable reason for this Court to interfere
with the order passed by the learned V Additional Principal Judge, Family
Court, Chennai, in granting the relief of maintenance to the wife.
