With respect to the status of the Commissioner of the erstwhile Municipal Corporation of Delhi (which would now be the status of the Commissioners in the 3 trifurcated Corporations) a Single Judge of this Court in the decision reported as 1989 (39) DLT 517 Nirmal Kumar Jain & Ors. vs. Municipal Corporation of Delhi and Anr, which was upheld by a Division Bench of this Court in the decision reported as 2000 (56) DRJ 29 Nirmal Kumar Jain vs. Municipal Corporation of Delhi and also the Supreme Court as per decision reported as 2000 (87) DLT 557 (SC) B.S Khurana vs. Municipal Corporation of Delhi held the Commissioner is not an employee of the Corporations. The view taken was the Commissioner is not subordinate to the Standing Committee. The view taken was that the Commissioner of the Corporation holds a unique position under the Delhi Municipal Corporation Act, 1957. His status was at par with statutory authorities constituted under the Delhi Municipal Corporation Act, 1957.
