In that context, the Tribunal referred to
and relied on a judgment of this Court rendered in the case of Uttara Co-
Operative Housing Society Ltd. Vs. State of West Bengal and Others reported
in (1991) 1 CAL LT 441 HC. Strangely enough, this judgment was cited before
the Tribunal by the appellant, Naba Kailash, which appears to have taken up
cudgels on behalf of Mira Deb. Undoubtedly, if a person likely to get affected by
an order of competent forum is not made a party in the proceeding, such a
person shall have every reason to feel aggrieved. However, in the instant case, it
is not Mira Deb who has come forward, but Naba Kailash. At this juncture, it is
necessary to take note of the stand taken by Naba Kailash before the Arbitrator,
which is as follows:-
