Learned counsel for the appellant has placed reliance on the
judgment of the Hon'ble Delhi High Court in Sh. Narsingh
Shah vs. BDR Developers Pvt. Ltd. (supra). However, no
violation or deviation by the Learned Trial Court from the
principles laid down in the said judgment has been found. As
already discussed, the notice under Order XV-A CPC was
duly and validly issued.
