43. We are supported in the view we have taken also by order
dated 14th May, 2009 passed by the Supreme Court in
SLP(C)No.1877/2007 entitled Ajay Kumar v. Union of India &
Ors. wherein the court agreed with the opinion of the Post
Graduate Institute of Medical Education and Research, Chandigarh
which had found the petitioner medically fit for the post of
Constable in the CRPF who had no manifest squint even though he
had exophoria for near with slow recovery. The order of the
Supreme Court reads as follows:-
In support of the contention that the Rules of 16th April,
2011 do not render the petitioners unfit, reliance is placed on the
decision dated 23rd July, 2012 in W.P.(C)No.9085/2011 titled
Tholu Rocky v. Director General, CISF & Ors. wherein the Court
held as follows:-
