Section 298 in Bharatiya Nyaya Sanhita, 2023
298. Injuring or defiling place of worship with intent to insult religion of any class
after
following due process of law. There is no intentional act of defiling
to insult religious feelings. The applicant belongs to same
community. There ... place of worship or sacred object that
could have been defiled or damaged. The work of leveling was
going on after obtaining permission from competent
peruse the following bare provisions of
law :
"295. Injuring or defiling place of worship, with intent to insult
the religion of any class.-- Whoever ... destroys, damages or defiles
any place of worship, or any object held sacred by any class of
persons with the intention of thereby insulting
furtherance of common criminal intention to
damage the temple property and to defile the temple. It was alleged by the
complainant, that he dissuaded ... furtherance of common criminal intention to
damage the temple property and defile the sanctity of temple, as defined
under section
same has been reproduced below:-
"295. Injuring or defiling place of worship, with intent to
insult the religion of any class.--Whoever destroys, damages ... defiles any place of worship, or any object held sacred by any
class of persons with the intention of thereby insulting the
religion

Section 295 of IPC which reads as under

defiles any place of worship, or any

persons with the intention of thereby
insulting
better understanding Section 295 IPC is extracted hereunder:
"295. Injuring or defiling place of worship, with intent to
insult the religion of any class ... Whoever destroys, damages or defiles any place of worship, or
any object held sacred by any class of persons with the intention
of thereby insulting
insult and to and attack on, the national symbols by burning,
trampling , defiling or mutilating in public.
16. Sec.2 of the Act deals with ... place or in any other place within public view burns,
mutilates, defaces, defiles, disfigures, destroys, tramples upon or
otherwise [shows disrespect to or] brings into
derogatory statements.
Further the accused posted defamatory messages to destroy,
damage or defile any place of worship or any object held sacred by
class ... with the knowledge that
is likely to consider such destruction, damage or defilement
