allegation of not carrying out any
execution to eject the petitioners is concerned, counsel for gaon sabha
has argued that period of execution ... receiving information or
on his own motion, eject any person who is liable to be
ejected from any land on a suit of the Gaon
ejectment when notice of ejectment has been
served. Section 42 of the Act says that "a tenant shall not be ejected
otherwise than ... execution of decree for ejectment, except in the
following cases : a) when a decree for an arrear of rent in respect of his
tenancy
ejectment.
4. The tenants having not complied with the order dated 7.7.1976
passed by the Assistant Collector 1st Grade, the petitioner-landowner filed
